Constitutional Issues/Governance & Compliance

The social housing team advises on the:

  • Incorporation and registration of RSLs
  • Review of constitutional arrangements for existing RSLs (whether for the RSL itself or for a group structure or other arrangement in which an RSL may participate) and
  • Interpretation of constitutions.

We have extensive experience in drafting policies for good governance and compliance with, for example, Performance Standards. We are familiar with the Regulator’s requirements in such matters. We can assist in creating best practice for you to comply with legislation and other relevant guidance.

Specialist advice is available for existing charities and bodies considering adopting charitable status.  We have particular experience of dealing with the Office of the Scottish Charity Regulator. Our expertise is based on sound legal knowledge and the personal experience of our practitioners, who are members of charity board / management committees.
