Regeneration
The creation of sustainable and vibrant communities is a key objective of many neighbourhoods and of local and central Governments. As a result, public and private sector organisations are working together with local people to regenerate our towns and our cities.
BTO has advised Urban Regeneration Companies, Registered Social Landlords and Scottish local authorities in several regeneration projects. We are experienced also in acting for organisations in the public and private sectors, such as local authorities, housebuilders, health service providers, statutory bodies, developers and funders.
Regeneration projects require a multi-disciplinary approach, involving many legal specialisms. Our team has expertise in procurement, property development, conveyancing, employment law, contracts, finance, environmental, planning, charity and commercial matters. This experience and our solid relationships with consultants and regulators make us ideally placed to assist those with an interest in urban regeneration in achieving their aims and demonstrating Best Value.
In addition, wide experience of servicing the needs of the social housing sector gives us a thorough understanding of the issues facing Urban Regeneration Companies, in particular the commercial and PR aspects.

Experience
- Major masterplan development
We have advised on this significant and strategically important project over a number of years, providing legal input to both the client and the project managers. Recent work has focussed on the development agreement (including detailed consideration of the provisions for shared infrastructure and application of Green Infrastructure funding) and related Deeds of Conditions and construction documentation. Key issues have been ensuring the future development of all phases and ensuring shared infrastructure is provided for in the context of the overall development. We have assisted with the acquisition of multiple key sites to form part of the overall development from the Local Authority as well as completion of related planning agreements. Additional work was undertaken in relation to a Joint Employer’s agreement with Scottish Canals regarding infrastructure works affecting to ensure adequate surface water drainage for the development.
- New town development
Advising a joint venture body, set up to facilitate the development of a new town, with thousands of new homes to be built over a planned number of years, supported by a masterfully designed town centre, schools, offices, shops and other retail.
- Joint venture
Undertaking commercial work for a joint venture company established by a local authority and an NHS Trust, BTO having advised regarding the constitution of the joint venture company. In the context of the joint venture, property assets are pooled/disposed of and the proceeds used in a regeneration programme. This is a multi-million pound project intended to progress over a period of many years.
- Major new-build regeneration
Acting for the acquiring landlord, taking on over 7000 residential units, BTO assisted in negotiation where a key element of our client’s business plan required demolition of over a third of the transferring housing stock with a major regeneration and new-build programme to follow, all of which required to be properly provided for in the contractual transfer and funding documentation (with both government and lenders).
- Options appraisal
Advising a local authority and providing an Options Appraisal Report considering the wide variety of options available to the client to progress a regeneration project. Also, examining the various legal structures open to the client to achieve its goals.
