BTO’s clinical defence team specialises in representing health professionals under investigation by their regulatory bodies where concerns have been raised about their fitness to practise due to criminal conviction, misconduct, ill health or deficient professional performance. The team has considerable experience of the fitness to practise procedures of the GMC and GDC and has also represented chiropractors, nurses and pharmacists before their professional regulators.
The team appears regularly at interim orders hearings and has represented professionals at a number of lengthy and high profile fitness to practise cases including appeals to the Court of Session. The team handles a wide variety of cases, examples including practitioners with physical or mental health conditions that are alleged to present a risk to the public, registrants with criminal convictions including drink driving and fraud, allegations against a professional of poor performance following a formal assessment of competency and misconduct cases, whether arising out of professional or personal conduct, where there is an alleged failure to adhere to professional standards thereby posing a risk to the public’s confidence in the profession.
