Biography
Fraser is a specialist in risk and construction disputes with vast experience in working on high profile building and infrastructure projects across the UK for a mix of contractors, developers and construction professionals.
Highly regarded in his field, Fraser leads the commercial side of BTO’s contentious construction caseload.
He has over sixteen years of experience in dispute avoidance and dispute resolution that has been focused exclusively on the construction industry. While the majority of his caseload concerns pursuing and defending claims at adjudication, his practice also sees him regularly representing clients’ interests in the Court of Session, the Sheriff Court, Arbitration, Expert Determination and Mediation.
Types of construction claims dealt with by Fraser previously include: extensions of time; loss and expense; defective work on major transport/infrastructure projects; various types of building defects, upstream and downstream contractor insolvency under the various standard form contracts; professional negligence claims for and against construction professionals and contract termination issues.
Underscoring the breadth of his experience, Fraser also drafted, revised and negotiated building contracts, professional appointments, collateral warranties and ancillary documents.
He also has a Masters Degree (first class) in Construction Law and has, for many years in the period since, lectured on the course on a variety of topics. Fraser has also been recognised by the Law Society of Scotland as an Accredited Specialist in Construction Law (awaiting renewal).
