We have on a number of occasions noted case law on the definition of employee or worker, depending upon the relevant right in question.
A number of cases are proceeding through the courts on this matter, notably the Uber judgment (presently under appeal).
The Department for Business, Innovation and Skills has published the Employment Status Review, a 60 page analysis (which is dated December 2015!)

This document analyses the legal issues underpinning employment status, including the position in relation to certain atypical workers (including zero hours workers). There are no recommendations as such but the analysis notes the complexity of the law and the difficulty in keeping in step with modern working arrangements.
The law continues to change at a fast pace but can it ever keep up?
