The Department for Business, Energy and Industrial Strategy has updated its policy paper on national minimum wage (NMW) enforcement.

The paper sets out:

  • How the revised scheme to name employers who break NMW law operates

  • The changes made to the NMW financial penalty (which came into effect on 1 April 2016)

  • How the Government operates the civil and criminal enforcement regime of the NMW.

This is an important and complex area of the law. The paper can be found here: https://www.gov.uk/government/publications/enforcing-national-minimum-wage-law

Employers should ensure that the rules are followed carefully. Sadly there are still areas where the law is unclear and case law is required to clarify the position. Nevertheless employers need to ensure that the rules are followed given the very serious public and private consequences of breach. Speak to your expert BTO contact today.
