In Scotland, divorce is granted when the marriage has broken down irretrievably. This can be shown by one of the following: separation for at least one year with both parties’ consent, separation for two years without consent, adultery, or unreasonable behaviour. An interim gender recognition certificate can also be a ground for divorce.
The timescale depends on your circumstances and the procedure used. A simplified divorce, where there are no children under 16 and financial matters are settled, can take around six to eight weeks. If you need to use the ordinary procedure, especially where children or finances are involved, it may take longer.
The simplified procedure is available if there are no children under 16 and all financial matters are resolved. It is quicker and less costly. The ordinary procedure is required if there are children under 16 or if there are unresolved financial or property issues. The ordinary procedure usually involves more court involvement and legal support.
Assets and debts acquired during the marriage are considered “matrimonial property” and are usually divided fairly between both parties. The court aims for a fair split, but this does not always mean a 50/50 division. Factors such as the needs of any children, each party’s financial situation, and contributions to the marriage are considered. Legal advice is recommended to reach a binding agreement.
The welfare of the child is the court’s main concern. Decisions about where the child will live and contact with each parent are based on the child’s best interests. The court may consider the child’s views, depending on their age and maturity. Parents are encouraged to agree arrangements themselves, but if this is not possible, the court will decide.
