Surrogacy

Context

A same sex couple used an international clinic to undertake their surrogacy journey. They used their gametes together with a donor gamete. They sought legal advice in relation to the steps required to help them become the legal parents of the child after the surrogate gives birth.

The challenge

The couple had engaged the services of the international fertility clinic prior to obtaining legal advice with regards to what happens upon their return to Scotland and the steps required in order to have their relationship recognised legally.

Our approach

As experts in fertility law, we were able to guide them through every step in the process. We were on hand to assist with each step of the process, from having their baby returned to the UK through to securing the change in legal parenthood.

The outcomes

The couple applied to Court for a Parental Order and were successful. They are delighted that they are now recognised as the child’s legal parents.
