Legal Parentage

Context

A same sex male couple have two children who were each born as a result of a surrogacy journey. They did not live in Scotland at the time the children were born. They wished to have their status as parents legally recognised in Scotland, them having moved to Scotland after the children were born.

The challenge

The option of applying for Parental Orders in respect of the children were not available, due to neither of them being domiciled in the UK and the time bar having passed.

We assisted the couple in applying for the Adoption Orders, which were successfully granted.
