PART 1 - It’s About Time
The Prescription (Scotland) Act 2018 reforms the landscape for prescription (limitation) periods for obligations to pay damages in Scotland. The 5 year and 20 year time bar dates are amended in certain circumstances (mostly related to latent damage).
This seminar will:
- look at the case law which led to the change
- examine what triggers the start of the time bar periods and the core deadlines under the new rules; and
- consider the differences between Scottish and English law.
PART 2 - Understanding Scottish Prescription and Limitation Law in Personal Injury Claims
We will discuss how different rules apply north of the border on all types of personal injury claims including disease and child abuse, and current proposals for reform.
