Biography

Allan, Derek

A “star individual” Derek heads the firm’s Professional Liability team and has extensive experience in acting for major insurers in professional indemnity claims. He is a recognised expert in his field who is praised for his "meticulous approach to his cases.”

Although acting for a range of professionals he is known in the Scottish market as "the outstanding person for solicitor disputes" and praised for his "fantastic attention to detail".  Peers praise his "high-quality advice" and agree that "if I wanted someone to look after my interests he would be the person that I would turn to." (Chambers UK).

Derek has been involved in various areas of professional liability work and associated litigation since 1984. He has for many years acted for the insurers under the Law Society of Scotland Master Policy in investigating and defending claims made against solicitors for alleged breach of contract or negligence. He also assists The Law Society of Scotland in the delivery to its members of Risk Management Seminars.

In addition, he has acted on behalf of accountants, surveyors and other professionals in the defence of claims brought against them. Derek and his partner Alan Eadie, both of whom are “highly regarded” (Legal 500) have presented to the Association of Chartered Certified Accountants (“ACCA”) on risk management issues.

On an increasing basis, he also acts for individuals and corporate clients where Scots law applies in the pursuit of claims against professionals for negligence and breach of contract.

Derek supports strongly the use of mediation, in appropriate circumstances, and is well aware of the benefits that mediation can offer over the conventional litigation process. He is himself a qualified mediator and has extensive experience of representing clients, and achieving successful outcomes for them, at mediations.

Derek perceives his role as facilitating the investigation, resolution and settling of claims as quickly and inexpensively as possible, drawing on his vast experience in this area.

External Appointments

Derek is a Member of the Law Society of Scotland's Professional Negligence Law Accreditation Panel and Member of the Professional Practice Committee of the Law Society of Scotland. Derek is a mentor for students on the University of Glasgow legal diploma course.
