There will be very few employers who have never had to deal with employee departures, whether by resignation or by dismissal.

It is a reality of the modern workplace that some staff will be unhappy and look to move on to pastures new. Your concerns will include: Will that unhappiness lead to employment tribunal claims? Will that employee join a competitor and misuse the connections they have built up with our clients to try and “poach” business?

Employers will also, inevitably, have to deal with dismissals. Dismissals may be necessary for many reasons. For example: poor performance, sickness absence, a disruptive attitude, redundancy, or simply a realisation that this person is not right for the business. In any dismissal there are risks to be managed and steps to be taken to ensure that the employer is doing the right thing to avoid legal claims.

In some cases, a potential “shortcut” will be to have a “protected conversation” with the employee and to offer a mutually agreed termination package, subject to a Settlement Agreement. Such conversations need to be handled with great care and the strategy needs to be correct to achieve your desired result – and avoid claims.

This session will look at:

  • What are the issues that arise in relation to termination of employment?
  • What are the risks arising from employee resignations, and from dealing with performance, misconduct, absence, redundancy?
  • How can these risks be minimised?
  • How can you protect your trade secrets and client connections?
  • In what circumstances might an “exit package” be offered?
  • What are the legal consequences of having such a discussion?
  • What should be discussed and what should the terms of the offer be?
  • The importance of creating a Settlement Agreement that is properly tailored for your needs.
