The situation in which a construction professional owes a duty of care to a third party for damage caused to their property, as a result of defective design or workmanship, is a complex one.  Since Murphy v Brentwood, the court has for years grappled with the existence and scope of such extra-contractual liabilities.  Sandra Cassels, Partner, and Jilly Petrie, Associate, of bto’s Construction and Engineering team will discuss some of the recent cases on this topic, focusing on how the law has developed, where we are now and the uncertainties which remain.
