Description:

Patrice Fabien, Partner, and Marion Davis, Associate and Accredited Specialist in Charity Law, will discuss the changing landscape of Notifiable Events for Registered Social Landlords (RSLs).

The Scottish Housing Regulator (SHR) requires RSLs to notify them of “any significant or exceptional issue, event, or change”. This session will review what is required today, and issues to consider as well as the potential consequences when notifying SHR – whether with the SHR or others.

In light of anticipated changes to the SHR’s powers (in response to the reclassification of RSLs by the Office of National Statistics), the session will consider if the SHR Notifiable Event regime is also open to change.

Over 90% of RSLs are charities, so this session will also consider the role of the Office of the Scottish Regulator (OSCR) and the potential impact on a charitable RSL should an SHR Notifiable Event occur. Our commentary will include the separate Notifiable Events regime for charities, introduced by OSCR in April 2016.

Patrice and Marion will illustrate their discussion with examples and cautionary tales!
