Description:

“Court Round Up & Reforms”
Wendy Thomson, Partner & Solicitor Advocate and Karina McShane, Partner

  • Update on recent case law
  • The Court Reforms

It’s a time of significant procedural change for civil practitioners in Scotland. We will guide you through what you need to know about the court reforms and provide an overview of recent cases of note, including our experience of succeeding at jury trial.

“Cyber Insurance: Where next?”
Paul Motion, Partner & Solicitor Advocate

“Cyber” claims and the amounts of cover written are both increasing exponentially. Firewalls and other technical measures can reduce a business’s exposure to cyber-attacks, although criminals and hackers are always probing for new weaknesses. There is also a human facet to cyber security. A recent trend is the exploitation of human nature and trust, through so called “spear phishing”.

The motives for cyber-attacks are often, though not always, financial. The recent Ashley Madison hack was allegedly motivated by altruism in exposing that a $20 “Delete fee” was being charged by the website but personal data was not then deleted.

This presentation will:

  • Discuss recent high profile cyber attacks
  • Identify trends
  • Provide an update on the EU General Data Protection Regulation (which proposes much higher fines for data breaches)
  • Provide updates on recent court decisions that appear to lower the threshold for personal data loss damages claims and expose private households to claims arising from domestic CCTV usage.

“An Introduction to the Insurance Act 2015”
Angus Crawford, Partner

  • The duty of fair presentation
  • The insured`s duty of disclosure and to search for documents
  • The ability to contract out of the Act
  • Warranties
  • The effect on remedies for fraudulent claims.
“The level of service has always been excellent, with properly experienced solicitors dealing with appropriate cases" Legal 500
