Dismissing employees with short service: Managing the risk (Glasgow)

In April 2012, the necessary qualifying service to claim “normal” unfair dismissal was increased from one year to two years. This increase was seen as shifting the “balance of power” back to the employer, and it is certainly the case that employees with 2 years’ service have a valuable right that their newer colleagues do not have. However, given the many pitfalls that can lead to claims and major liabilities, employers who believe that they can act with impunity towards short-serving employees run significant risks.

Description:

In April 2012, the necessary qualifying service to claim “normal” unfair dismissal was increased from one year to two years. This increase was seen as shifting the “balance of power” back to the employer, and it is certainly the case that employees with 2 years’ service have a valuable right that their newer colleagues do not have. However, given the many pitfalls that can lead to claims and major liabilities, employers who believe that they can act with impunity towards short-serving employees run significant risks.

Forewarned is forearmed. This session will look at key practical and legal issues and tactical considerations when dealing with, and considering dismissal of, your short serving employees, including:

  • Calculation of 2 years’ qualifying service
  • Breach of contract claims
  • Risk of claims for automatically unfair dismissal
  • Potential discrimination angles
  • Protection of part time and fixed term staff
  • Liabilities toward those with no service at all
  • Benefits of a probationary period?
  • Pros and cons of following a dismissal procedure

If you have short serving employees working within your organisation, this session should not be missed.
