Each charitable RSL is controlled and managed by a Board or Management Committee who are the charity trustees responsible for the governance and strategy of their RSL. It is important that, in undertaking this role the Board / Committee members understand their duties and responsibilities under charity law and the role of the Office of the Scottish Charity Regulator (OSCR) as well as the Scottish Housing Regulator (SHR). 

What the course covers

  • Duties and responsibilities of a charity trustee under the Charities and Trustee Investment (Scotland) Act 2005 and the role of OSCR 
  • Practical examples considered through case studies

  • What is expected of individual trustees under law
  • Understand the role of OSCR as the Charity Regulator
     

This session will be delivered by Marion Davis, an Associate with BTO Solicitors LLP, Glasgow, who is accredited by the Law Society of Scotland as a specialist in Charity Law.

Marion works with a wide range of RSLs, both large and small, advising primarily on governance, policy and contract issues and she has worked in the past on secondment with OSCR. Her governance work includes advising on constitutions, key governance documents such as codes of conduct for trustees and staff, and regulatory intervention. She has also advised many RSLs on work that is, or should be, carried out by trading subsidiaries and relationships between RSLs and other organisations.
