BTO will provide an update on developments in court attitudes and trends since the introduction of the Compulsory Pre-Action Protocol in November 2016. In order to illustrate what impact the protocol is having on personal injury claims, reference will be made to key decisions and consequences, both intended and unintended. Looking forward, as the Civil Litigation (Expenses and Group Proceedings) (Scotland) Bill enters the amendment stage in parliament, BTO will highlight the key elements that may be anticipated to emerge, alongside the debate around the Bill so far.
More broadly, there will be discussion on issues and attitudes in relation to other areas with cost implications such as sanction for Counsel in the Sheriff Courts and Expert Witness instruction.
