The Scottish Government’s consultation on the proposed introduction of Periodical Payment Orders (PPOs) in Scotland closed on 11 September 2017.
The consultation invited comments upon draft legislative provisions which may go on to form the basis of an amendment to section 2 of the Damages Act 1996.
The intention of the provisions is to place the Scottish Courts on an equivalent footing with the rest of the UK by requiring the Scottish Courts to consider PPOs in every case in which damages for future pecuniary loss are awarded and the draft legislation seeks to allow the Courts to impose PPOs without the consent of the parties, if appropriate.
The Scottish Government will now consider the responses submitted to the consultation and it is likely to publish those responses, together with its intentions to move the legislative amendment forward.
